This document (as well as other documents mentioned herein) governs the terms under which the use of this Website (SINGLE QUIVER) and the purchase or acquisition of products and/or services through it (hereinafter, Terms) are regulated.

For the purposes of these Terms, the activity carried out through the Website https://www.singlequiver.com/ includes: Retail marketing and sale of products.

In addition to reading these Terms, before accessing, browsing, and/or using this website, the User must have read the Legal Notice and the General Terms of Use, including the cookie policy, and the privacy and data protection policy of https://www.singlequiver.com/. By using this Website or by requesting the acquisition of a product and/or service through it, the User agrees to be bound by these Terms and by all the aforementioned, so if you do not agree with all of this, you should not use this Website.

Furthermore, it is informed that these Terms may be modified. The User is responsible for reviewing them each time they access, browse, and/or use the Website, as those in effect at the time of requesting the acquisition of products and/or services will apply.

2. THE USER

Accessing, browsing, and using the Website confers the status of user (hereinafter referred to, indistinctly, individually as User or collectively as Users), therefore, from the moment browsing begins, all the Conditions established here are accepted, as well as their subsequent modifications, without prejudice to the application of the corresponding legally binding regulations, as appropriate.

The User assumes responsibility for the correct use of the Website. This responsibility will extend to:

  • Using this Website only to make legally valid inquiries and purchases or acquisitions.
  • Not making any false or fraudulent purchases. If it could reasonably be considered that such a purchase has been made, it may be canceled, and the relevant authorities will be informed.
  • Providing truthful and lawful contact details, for example, email address, postal address, and/or other information (see Legal Notice and General Terms of Use).

The User declares to be over 18 years old and to have the legal capacity to enter into contracts through this Website.

The User may formalize, at their choice, with https://www.singlequiver.com/ the purchase contract of the desired products and/or services in any of the languages in which these Terms are available on this Website.

3. PURCHASE OR ACQUISITION PROCESS

Properly registered Users can make purchases on the Website through the means and procedures established. They must follow the SINGLE QUIVER online purchase and/or acquisition process, during which several products and/or services may be selected and added to the shopping cart or final purchase area, and finally, click on: "Buy".

Likewise, the User must fill in and/or verify the information requested at each step, although during the purchase process, before making payment, they may modify the purchase data.

The User will then receive an email confirming that https://www.singlequiver.com/ has received their order or purchase request and/or service provision, that is, the order confirmation. If applicable, the User will also be informed by email when their purchase is being shipped. These communications may also be available in the User's personal account on the Website.

Once the purchase process is completed, the User agrees that the Website will generate an electronic invoice that will be sent via email and, if applicable, also available in the User’s personal account on the Website.

The User acknowledges being aware, at the time of purchase, of certain specific sales conditions concerning the product and/or service in question, which are shown alongside the product description or image on the Website, including but not limited to: name, price, components, weight, quantity, color, product details or features, and method and/or cost of provision; and acknowledges that placing the purchase order constitutes full and complete acceptance of the applicable specific sales conditions.

4. AVAILABILITY

All purchase orders received through https://www.singlequiver.com/ are subject to product availability and/or force majeure circumstances that may affect the supply of the products and/or provision of the services.

If there are difficulties in the supply of products or if items are out of stock, https://www.singlequiver.com/ commits to contacting the User and refunding any amount that may have been paid. This also applies in cases where the provision of a service becomes unfeasible.

5. PRICES AND PAYMENT

The prices displayed on the Website are final prices, in Euros (€), and include taxes, unless otherwise indicated by legal requirement, particularly concerning VAT.

Shipping costs are included at the final step of the checkout process. Deliveries are made through: Correos Express, Correos, FedEx, UPS.

The Website will not automatically add any additional costs to the price of a product or service, only those selected and freely chosen by the User.

Accepted payment methods are: Credit or debit card, PayPal, and Bank Transfer.

https://www.singlequiver.com/ uses all means to guarantee the confidentiality and security of payment details transmitted by the User during transactions through the Website. It uses a secure payment system SSL (Secure Socket Layer).

Credit cards are subject to verification and authorization by the issuing bank. If the payment is not authorized, https://www.singlequiver.com/ will not be responsible for any delay or non-delivery and will not be able to formalize any contract with the User.

Once https://www.singlequiver.com/ receives the purchase order, a pre-authorization will be made on the corresponding card to ensure that there are sufficient funds. The charge will be made when the shipment or service confirmation is sent.

By clicking on "Buy", the User confirms that the payment method used is theirs.

6. DELIVERY

Physical deliveries of products will be made globally. The recipient is responsible for all customs duties and taxes. Refused packages will not be refunded. Customers must pay applicable customs duties and taxes determined by their local government. We cannot provide the exact amount of these charges. Please consult your local government for details. By completing your order, you agree to pay all applicable charges. If a shipment is returned due to an incorrect or incomplete address or missed delivery attempts, the customer will bear the cost of the second shipment.

Except in cases of unforeseen or extraordinary circumstances, or product customization, orders will be delivered within the time indicated on the Website and, in any case, within a maximum period of 30 calendar days from order confirmation. Some products may have longer delivery times if not in stock. Check the product page for details.

Custom surfboards may take between 3 and 8 weeks to be delivered depending on the brand and technology, unless in stock, in which case they are shipped the next business day after payment confirmation. Contact us at support@singlequiver.com to confirm the delivery time for your custom board.

Orders are processed within one business day. Therefore, the shipping address cannot be changed once the order is confirmed. To change the delivery address after ordering, go to your customer account and update it under the addresses section.

If delivery is not possible due to the User's absence, the package may be returned to the warehouse. The courier will leave a notice with information on where the package is and how to arrange a new delivery.

If the User will not be at the delivery location at the agreed time, they must contact the courier company.

If 30 days pass from the availability of the order for delivery and it has not been delivered for reasons not attributable to https://www.singlequiver.com/, it will be understood that the User wishes to withdraw from the contract, which will be considered resolved.

As a consequence of the resolution, all payments received will be refunded, except for any additional shipping charges. Return shipping costs due to withdrawal may be charged to the User.

7. TECHNICAL MEANS TO CORRECT ERRORS

The User is informed that if an error is detected when entering necessary data to process their purchase request on the Website, it may be corrected by contacting https://www.singlequiver.com/ through the contact areas provided on the Website or, where appropriate, through those enabled to contact customer service, and/or using the contact details provided in clause one (General Information). These corrections may also be made in the User's personal area.

In any case, before clicking on "Buy", the User has access to the shopping cart where purchase requests are recorded and can make modifications.

Likewise, the User is referred to consult the Legal Notice and General Terms of Use and, in particular, the Privacy Policy for more information on how to exercise their right of rectification as established in Regulation (EU) 2016/679 and Organic Law 3/2018 on Personal Data Protection and digital rights guarantee.

8. RETURNS

Right of Withdrawal

The User, as a consumer and user, has the right to withdraw from the purchase within 14 calendar days without the need for justification, except in the case of customized surfboards.

This withdrawal period will expire 14 calendar days after the day on which the User or a third party authorized by them acquires material possession of the goods. If the goods in the order are delivered separately, the period begins when the User acquires possession of the last item.

To exercise this right, the User must notify https://www.singlequiver.com/. This can be done through the contact forms on the Website or any other unequivocal method.

The User must clearly state their intention to withdraw from the contract. A withdrawal form is available, but its use is not mandatory.

To meet the withdrawal deadline, it is sufficient that the communication is sent before the period expires.

In the event of withdrawal, the amount paid will be refunded using the same payment method unless another method is expressly agreed. The refund may be withheld until the goods are received or proof of their return is provided.

The User must return the goods to: Calle Galileo-Galilei, 11, 11500 El Puerto de Santa María, Cadiz, Spain without undue delay and in any case no later than 14 calendar days from notification.

The User acknowledges that they must bear the direct cost of returning the goods and will be responsible for any diminished value due to handling beyond what is necessary.

Exceptions to the right of withdrawal include:

  • Customized products
  • Perishable or quickly expiring goods
  • Unsealed CDs/DVDs
  • Products unsealed after delivery that cannot be returned for hygiene reasons

No refund will be made if the product has been used beyond checking it, or is not returned in the same condition, or has been damaged after delivery. It must be returned with all original packaging and documents, including a copy of the invoice.

Return of Defective Products or Shipping Errors

If the User believes that a product does not conform to the contract at the time of delivery, they must contact https://www.singlequiver.com/ immediately, indicating the issue.

The product will be examined, and the User will be informed within a reasonable time if a refund or replacement is appropriate. The refund or replacement will be processed as soon as possible, and in any case, within 14 days.

The amount paid for defective products, when applicable, will be fully refunded, including delivery costs, using the same payment method used by the User.

Guarantees

The User, as a consumer, is entitled to guarantees on the products purchased under the legally established terms for each type of product.

Products are considered compliant if they match the description, are fit for usual purposes, and show the expected quality and performance. If not, the User must act as described above.

Some products may show non-uniform features due to the natural materials used, which will not be considered defects.

If the product is manufactured by a third party, the User may contact the manufacturer to enforce the legal guarantee directly within one year of delivery, keeping all warranty information.

9. DISCLAIMER OF LIABILITY

Unless otherwise legally provided, https://www.singlequiver.com/ will not be liable for any losses not attributable to any breach by them; business losses; or any indirect loss not reasonably foreseeable when the contract was entered.

Also, https://www.singlequiver.com/ limits liability in the following cases:

  • Minimal differences between the product and its representation on the Website.
  • Delays or failures due to transportation issues such as strikes or roadblocks.
  • Technical failures preventing access or normal service operation.
  • Misuse or wear by the User or incorrect returns.
  • Force majeure preventing compliance with obligations.

Obligations will be suspended during the force majeure event, and an extension equal to the duration of the event will be granted to fulfill them.

10. WRITTEN COMMUNICATIONS AND NOTIFICATIONS

By using this Website, the User agrees that most communications will be electronic. They accept the use of electronic means to fulfill legal requirements to provide information in writing.

11. WAIVER

Failure to demand strict compliance or to exercise a right does not constitute a waiver of such right unless expressly stated in writing.

12. SEVERABILITY

If any of these Terms is declared null or unenforceable by final resolution of a competent authority, the remaining clauses will remain in force.

13. ENTIRE AGREEMENT

These Terms and any referenced documents constitute the entire agreement between the User and https://www.singlequiver.com/ and supersede any prior oral or written agreements.

14. DATA PROTECTION

Personal data provided during transactions will be handled according to our Privacy Policy. By using the Website, the User consents to the processing of such data and declares that the information is accurate.

15. APPLICABLE LAW AND JURISDICTION

Access and use of the Website and purchase contracts through it will be governed by Spanish law.

Any dispute arising from use or interpretation of these Terms will be submitted to the non-exclusive jurisdiction of Spanish courts.
